8.    Bike Rental and Tour Price
The bike rental/tour price is determined by the rates mentioned on the Madrid Trixi website ( the time of the booking, or as subsequently detailed on a quote or on your booking confirmation. Prices are valid for a period of 30 days after the date mentioned on the quote or on your booking confirmation.

9.    Booking
Your online booking will be considered confirmed when you receive a booking     confirmation per e-mail from Trixi Madrid o Paypal.

10.    Payment
a. The bicycle rental and tour price and any other due sums regarding the rental agreement must be paid before the bicycle(s) is/are handed over to you. If you decide to rent your bicycle(s) for a longer period than you paid for, just let us know by the end of the rental period. The same prices will apply as mentioned on the website and payment will be settled when returning the rented bicycle(s).
b. If, for whatever reason, you cannot make use of the bicycle(s) you have rented or the tour you have booked, Trixi Madrid will not be held responsible for any resulting expenses or damage.
c. In the case of 3b you remain obliged to pay the full rental price or tour price and any other amounts mentioned in the invoice, unless you can prove that your  not being able to use the bike or to go on the tour was the consequence of a defect that was already present at the beginning of the rental or touring period.

11.    Deposit
Before receiving the rental bicycle(s), you must leave a deposit of €150€ /bike (300€ if you rent an electric bike) to be paid in cash or with credit card. The deposit will be returned to you upon returning the bicycle(s) in good order.

12.    Period
a. The rental period or touring period are the periods as stated on the booking confirmation.
b. Extension of the rental period is possible only after approval by us and according to the rental rates as mentioned above (1).
c. No refunds are possible after the rental period or touring period begins. If you return the bicycle(s) to us before the end of mentioned period, the rental or touring agreement will automatically be terminated, without altering the payment done at the start of the rental or touring period.
d. At the end of your rental or touring period, the bicycle(s) must be returned to the Trixi Madrid shop (C/Jardines 12) from where it was/they were issued.
e. If the bicycle(s) is/are not returned by the return time stated on the booking confirmation, we will continue to charge you rent until the bike(s) is/are returned to us. In the event of late return, the rates as mentioned above (1) will continue to apply. We also reserve the right to demand payment for any costs and/or damages suffered by us due to late return of our rental bicycle(s).
f. Notwithstanding the preceding paragraph, in the event of late return of our rental bikes, we reserve the right to dissolve the rental agreement without judicial intervention and immediately claim back our bicycle(s) wherever it/they may be and from whomever has it/them. Trixi Madrid also holds this right in the event that you do not comply with any of the other conditions stated in this rental agreement.

13    Cancellation Policy
In case of the cancellation of a tour or rental booking, you will receive a refund of 80% of the rental or touring fee if the cancellation takes place up to a week before the beginning of the rental or touring period. If cancellation takes place a week to 48 hours before the start of the rental or touring period, you receive a refund of 50% of the rental or touring fee. In case of rain or other weather related reasons, Trixi Madrid will offer an alternative rental- or touring period, or activity.

14.    Proper Use
a. The bicycle(s) may only be used for its/their intended purpose. The client listed on the contract is responsible for the proper use of all bicycles listed on the contract and all persons using the bike.
b. The bicycle(s) must be returned to us in the same clean state in which you received it/them.
c. You must take excellent care of the bicycle(s), as if it/they were your own. You must take every precaution against damage, loss or theft.
e. The local bicycle regulations must be complied with, very importantly also the rules concerning the parking of bicycles.

15.    Damage, Loss and Theft
You assume full responsibility for any damage to or loss of the bicycle(s) or parts of it/them, as well as bicycle keys, chains and locks, and for any possible damage related to the use of the rented bicycle(s). You also agree to compensate Trixi Madrid the cost of repair or replacement of the bicycle(s) for such an amount as is determined by us according to standard market prices. In any case, you are the sole responsible for possible damages to yourself, the bicycle and third parties. Trixi Madrid does not assume any responsibility for any personal injury or other damage caused by the use of the rented bicycle(s).

16.    Force majeur
If Trixi Madrid cannot fulfill its obligations to you as a result of circumstances beyond its control; the obligations will be suspended for the duration of the force majeure. In this context, force majeure will mean any circumstance independent on Trixi Madrid will, which partly or wholly prevents the fulfillment of its obligations towards you or which reasonably renders the requirement to fulfill such obligations impossible, regardless if such circumstance could have been anticipated. Force majeure includes in any case: emergency situations (including extreme weather conditions, fire and lightning strike), restrictions and/or amended rules and regulations by governments or government agencies, (work) strike, war, riot, power failure, unanticipated failure of computer hardware and other facilities.

17. Applicable law / Governing Law
These Terms and all disputes following from or related to the Website, contracts and services shall  be governed by and construed in accordance with the laws of Spain. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Spanish courts.
